Welcome to BoraFit ("BoraFit", "we", "us"). These Terms govern your use of the BoraFit website, mobile experience, and any related services (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. What BoraFit is
BoraFit is a self-tracking tool for nutrition, body weight, and related fitness goals. It calculates macro and calorie targets from information you provide, helps you log food and weight, and adjusts your targets over time based on your weight trend. BoraFit is a general wellness product, not a medical device, not a clinical tool, and not a substitute for professional advice.
2. Eligibility
You must be at least 13 years old (or the minimum age required in your country to use online services without parental consent) to create a BoraFit account. By creating an account you represent that you meet this age requirement.
3. Your account
- Provide accurate information and keep it up to date.
- Keep your login credentials confidential. You are responsible for activity that happens under your account.
- Notify us promptly if you suspect unauthorized access.
- You may delete your account at any time from inside the app or by emailing us.
4. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms.
- Reverse-engineer, decompile, or attempt to extract source code, except as permitted by law.
- Scrape, crawl, or harvest data from the Service, or run automated tools that place an undue load on our infrastructure.
- Upload content that infringes others' rights, contains malware, or is illegal.
- Resell, sublicense, or otherwise commercially exploit the Service without our written permission.
- Misrepresent your identity or impersonate another person.
5. Health disclaimer — please read
BoraFit is not a medical service. The calorie targets, macro recommendations, and feedback BoraFit produces are general estimates based on widely used formulas. They are not medical advice, diagnosis, or treatment, and they cannot account for your specific medical history, conditions, or medications.
Before starting any diet, fitness, or weight-loss program — and especially if you have a medical condition, are pregnant or breastfeeding, have a history of disordered eating, are under 18, or take medication — consult a qualified healthcare professional.
You are solely responsible for any decisions you make based on BoraFit's outputs. If you experience symptoms or feel unwell, stop and seek medical attention. BoraFit is not designed to diagnose, treat, or prevent any disease.
6. AI features and accuracy
Some features (such as photo-based meal logging and natural-language meal parsing) use third-party artificial intelligence services. AI outputs are estimates and can be wrong. Always verify what BoraFit adds to your log against the actual food, portion, and source you consumed. Nutrition values from the public food databases we use (Open Food Facts, USDA) are user-contributed or sourced from manufacturers and may also contain errors.
7. Connected services
BoraFit can integrate with third-party services (for example, Google Health). When you connect such a service, you authorize BoraFit to access the specific data described in our Privacy Policy. Your use of those third-party services is governed by their own terms. We are not responsible for outages, errors, or changes in those services.
8. Your content
You retain ownership of the content you create in BoraFit (food logs, weight entries, photos, notes). You grant us a limited, worldwide, non-exclusive license to host and process that content only as needed to provide the Service to you. We do not claim ownership of your data and we do not use it to train AI models.
9. Our intellectual property
The BoraFit name, logo, app design, and underlying software are our property (or our licensors') and are protected by copyright, trademark, and other laws. These Terms do not grant you any rights in our brand or code other than the right to use the Service as intended.
10. Pricing and changes to the Service
BoraFit is currently free to use. We may add paid plans in the future; if we do, paid features and pricing will be disclosed before you are asked to pay. We may add, change, suspend, or discontinue any part of the Service at any time. We will try to give reasonable notice for material changes that affect existing users, but we are not obligated to do so.
11. Termination
You can stop using BoraFit and delete your account at any time. We may suspend or terminate your account if you violate these Terms, if your use creates security or legal risk for us or others, or if we discontinue the Service. On termination, your right to use the Service ends; provisions that should reasonably survive (such as ownership, disclaimers, and limitations of liability) will survive.
12. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. We do not warrant that the Service will be uninterrupted, secure, or error-free, that defects will be corrected, or that any data will be accurate or reliable.
13. Limitation of liability
To the fullest extent permitted by law, BoraFit and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses arising out of or in connection with your use of the Service.
Our total cumulative liability for any claims arising from or related to the Service will not exceed the greater of (a) the total amount you have paid us in the 12 months preceding the claim, or (b) one hundred euros (EUR 100). Some jurisdictions do not allow these limitations; in those places, our liability is limited to the smallest amount permitted by law.
14. Indemnification
You agree to indemnify and hold harmless BoraFit, its operators, and its service providers from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your misuse of the Service, your violation of these Terms, or your violation of any rights of a third party.
15. Governing law and disputes
These Terms are governed by the laws of the Netherlands, without regard to its conflict-of-laws rules. Any dispute arising under these Terms will be resolved in the courts located in the Netherlands, unless mandatory consumer-protection law in your country of residence grants you additional rights.
16. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the "Effective" date and notify you in the app or by email. Continued use of the Service after the new effective date means you accept the updated Terms.
